Terms and Conditions of Use of the Terabyte Technologies Website

For purposes of these terms and conditions of use of the Terabyte Technologies website, ” website ” shall mean PCX Technologies, and all of its direct affiliates and subsidiaries.

1. Acceptance of terms and conditions

Terabyte Technologies provides the information contained on this website and any pages comprising the website (“www.terabytedesigns.co.za”) to you subject to the terms and conditions of use of the Terabyte Technologies website set out herein (“terms and conditions”). By accessing, using and/or downloading any information from the website, you are deemed to have accepted and agreed to the terms and conditions. If you do not accept and agree to the terms and conditions, do not access, use or download any information from the website.

2. Modification of terms and conditions

Terabyte Technologies may at any time in its sole and absolute discretion modify the terms and conditions without notice to you and your continued access or use of the website will be subject to the terms and conditions in force at the time of such access or use. Accordingly, you should review the terms and conditions periodically as your continued access or use of the website shall be deemed to be your acceptance of the amended terms and conditions.

Whilst every effort is made to update the information contained on this website on a regular basis, Terabyte Technologies makes no representations or warranties, whether express, implied in law or residual, as to the accuracy, completeness or reliability of information, opinions, data and/or content contained on the website and shall not be bound in any manner by any information contained on the website. Terabyte Technologies reserves the right at any time to change the content or discontinue without notice, any aspect or feature of the website. No opinions, research information, data or content contained on the website (and whether posted by Terabyte Technologies or a third party) should be construed as advice and same are offered for information purposes only.

External links, including links to other websites, may be provided for your convenience, but they are beyond the control of Terabyte Technologies and no representation is made as to their content. Accordingly, any unauthorised copying, reproduction, retransmission, distribution, dissemination, sale, publication, broadcast or other circulation or exploitation of the materials or any component thereof will constitute an infringement of such copyright and other intellectual property rights. The trademarks, names, logos and service marks (collectively “trademarks”) displayed on the website are the registered and unregistered trademarks of Terabyte Technologies. Nothing contained on the website should be construed as granting any licence or right to use any trademark without the prior written permission of Terabyte Technologies. Without detracting from this, Terabyte Technologies hereby authorises you to view and use the content of this website, or any part thereof, provided that such content is used for information purposes only.

Terabyte Technologies is not responsible for any material submitted to the public areas by you (which include bulletin boards, chat rooms, or any other public area found on the website). Any material (whether submitted by you or any other user) is not endorsed, reviewed or approved by Terabyte Technologies. Terabyte Technologies reserves the right to remove any material submitted or posted by you in the public areas, without notice to you, if it becomes aware and determines, in its sole and absolute discretion, that there is a possibility that you may –
1. defame, abuse, harass, stalk, threaten or otherwise violate the rights of other users or any third parties;
2. publish, post, distribute or disseminate any defamatory, obscene, indecent or unlawful material or information;
3. upload files that contain viruses, corrupted files or any other similar software or (computer) programs that may damage the operation of Terabyte Technologies’s and/or a third party’s computer system and/or network;
4. violate any copyright, trademark, other applicable laws or intellectual property rights of Terabyte Technologies or any other third party;
5. submit contents containing marketing or promotional material which is intended to solicit business.

7. Transmission of information

Your attention is drawn to the fact that information transmitted via the internet to Terabyte Technologies is susceptible to monitoring and interception. Terabyte Technologies reserves the right to request independent verification in compliance with all applicable laws of any information transmitted and your consent to such verification should Terabyte Technologies deem it necessary. You further agree not to use the website to send or post any message or material that is unlawful, harassing, defamatory, abusive, indecent, threatening, harmful, vulgar, obscene, sexually orientated, racially offensive, profane, pornographic or which violates any applicable laws and you hereby indemnify Terabyte Technologies against any loss, liability, damage or expense of whatever nature which Terabyte Technologies or any third party may suffer which is caused by or attributable to, whether directly or indirectly, your use of the website.

8. Warranties and disclaimers

Terabyte Technologies makes no warranties, representations, statements or guarantees (whether express, implied in law or residual) regarding the website. To the extent permitted by applicable laws, Terabyte Technologies shall not be responsible for and disclaims all liability for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by you or any third party, as a result of or which may be attributable, directly or indirectly, to your access and/or use of the website and any information contained on the website and you waive any and all claims which you may have against Terabyte Technologies in respect of any loss, liability, damage (whether direct, indirect or consequential) or expense of any nature whatsoever, which may be suffered by you as a result of or which may be attributable directly or indirectly to the aforesaid. These limitations of liability shall apply regardless of the form of action, whether in contract, tort, delict, strict liability or otherwise, and regardless of whether either party has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Terabyte Technologies shall not be liable for any indirect, contingent or consequential loss (including but not limited to loss of business or loss of profits) incurred or sustained by you or any third party howsoever arising in respect of your use of or reliance on the website or any information offered on or via the website.

9. Privacy and data protection
Terabyte Technologies understand the importance of protecting your personal data. The Terabyte Technologies Privacy Policy sets out how Terabyte Technologies manages your personal data and applies to the website. Any personal data collected from you during your access or use of the website will be collected and managed in terms of the Terabyte Technologies Privacy Policy, as amended from time to time, and all applicable privacy and data protection laws.

10. General

1. These terms and conditions constitute the sole record of the agreement between you and Terabyte Technologies in relation to the subject matter hereof. Neither you nor Terabyte Technologies shall be bound by any express, tacit or implied representation, warranty, promise or the like not recorded herein. These terms and conditions supersede and replace all prior commitments, undertakings or representations, whether written or oral, between you and Terabyte Technologies in respect of the subject matter hereof. No addition to, variation or agreed cancellation of any provision of these terms and conditions shall be binding upon Terabyte Technologies unless agreed to by Terabyte Technologies. No indulgence or extension of time which Terabyte Technologies may grant to you will constitute a waiver of or, whether by estoppel or otherwise, limit any of the existing or future rights of Terabyte Technologies in terms hereof, save in the event or to the extent that Terabyte Technologies has signed a written document expressly waiving or limiting such rights.

2. Terabyte Technologies shall be entitled to cede, assign and delegate all or any of its rights and obligations in terms of these terms and conditions to any third party without notice to you.

3. All provisions of these terms and conditions are, notwithstanding the manner in which they have been linked grammatically, severable from each other. Any provision of these terms and conditions which is or becomes unenforceable in any jurisdiction, whether due to voidness, invalidity, illegality, unlawfulness or for any reason whatever shall, in such jurisdiction only and only to the extent that it is so unenforceable, be disregarded and the remaining provisions of these terms and conditions shall remain of full force and effect.

4. These terms and conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa without giving effect to any principles of conflict of law. You hereby consent to exclusive jurisdiction of the South African courts in respect of any disputes arising in connection with these terms and conditions or any matter related to or in connection therewith.

These Terms and Conditions (“Agreement”) are entered into by and between Terabyte Technologies (“Terabyte”, “we”, “us” or “our”) and the client or customer (“Client”, “you” or “your”). By using Terabyte’s services, the Client agrees to be bound by these terms.


1. Parties
This Agreement is between Terabyte Technologies and the Client identified in the applicable Service Order.

2. Definitions
“Services” means any services provided by Terabyte, including but not limited to hosting, domain registration, email services, and related technical support. Other terms will have their commonly understood meanings unless otherwise defined herein.

3. How the Agreement Works
These Terms, together with any applicable Service Orders and appendices, constitute the entire agreement between the parties and supersede all prior negotiations or agreements.

4. Service Orders
Services will be rendered pursuant to Service Orders agreed upon by both parties. Each order shall specify services, duration, fees, and any additional conditions.

5. Term of Agreement and Renewal
This Agreement is effective from the date of the first Service Order and remains in effect unless terminated under clause 26. Services renew automatically unless otherwise specified.

6. Amendment of Terms
Terabyte reserves the right to amend these terms. Clients will be notified of material changes via email or website notice. Continued use after changes constitutes acceptance.

7. Initiation
Service initiation occurs once payment is confirmed and all required client information is received.

8. Fees and Payment
Fees are due as specified in the Service Order. Late payments may incur interest or suspension of services. All payments are non-refundable unless otherwise agreed.

9. Use of Services
Clients may only use Services for lawful purposes. Any use that violates local, national or international laws or regulations is prohibited.

10. Email Accounts
Email services must not be used to send spam, phishing attempts, or any unauthorized content. We reserve the right to suspend accounts for abuse.

11. Intellectual Property
All intellectual property rights in Terabyte’s services, software, or documentation remain with Terabyte or its licensors. Clients retain ownership of their content.

12. Security
Terabyte employs reasonable security measures but makes no guarantees against unauthorized access or data loss. Clients are responsible for maintaining secure passwords and credentials.

13. Suspension of Service
Terabyte may suspend service without liability if required for maintenance, law enforcement requests, or if the Client breaches this Agreement.

14. Data & Content
Clients are solely responsible for data hosted or transmitted using the Services. Terabyte does not guarantee data integrity or backup unless specified.

15. Statutory Compliance
Clients must comply with all applicable laws. Terabyte disclaims liability for any non-compliance by the Client.

16. Loss of License
If Terabyte loses a required license to operate, services may be discontinued with reasonable notice. No liability is accepted beyond fees already paid.

17. Risk and Ownership in Equipment
Ownership of physical equipment remains with Terabyte unless otherwise agreed. Clients assume risk upon delivery for any on-site installations.

18. Use and Maintenance of Equipment
Clients must not modify or damage equipment provided by Terabyte and must allow access for maintenance.

19. Limitation of Liability
To the maximum extent permitted by law, Terabyte is not liable for indirect, incidental, or consequential damages, including data loss, service interruptions, or security breaches.

20. Indemnity
Clients agree to indemnify and hold Terabyte harmless from any claims, damages, or losses resulting from the Client’s use of the Services, including legal fees.

21. Warranties
Terabyte disclaims all implied warranties including merchantability or fitness for a particular purpose. Services are provided “as is”.

22. Assignment, Subcontracting and Reselling
Clients may not assign or resell Services without prior written consent. Terabyte may subcontract portions of Services.

23. Relationship between the Parties
No joint venture, partnership, employment, or agency relationship exists. Each party is an independent contractor.

24. No Solicitation
Clients agree not to solicit or hire Terabyte’s staff or contractors for a period of 12 months following the termination of this Agreement.

25. Application of the Consumer Protection Act
If the CPA applies, these terms will be interpreted to give the Client the maximum protection it allows. Otherwise, it will be interpreted under general contract law.

26. Breach and Termination
Either party may terminate the Agreement for breach after 14 days’ written notice if the breach is not remedied. Immediate termination applies for serious violations.

27. Notices
All notices must be in writing and sent to the designated contact address or email specified by the parties.

28. Disputes
Disputes will be resolved first through negotiation. If unresolved, they will be referred to arbitration in accordance with local arbitration rules.

29. Force Majeure
Neither party is liable for delays or failure due to causes beyond reasonable control, including natural disasters, cyberattacks, or government actions.

30. Interpretation
Headings are for convenience only and do not affect interpretation. Singular includes plural and vice versa.

31. General
If any term is held invalid, the remainder shall remain in effect. No waiver by either party shall be construed as a continuing waiver.

32. Domain Registration, Renewal, Redemption, Deletion & Domain Parking
Domain services are subject to availability and third-party registrar rules. Terabyte is not responsible for domain loss due to non-renewal or failure to respond to registrar notices. Redemption fees and grace periods may apply.
